10 Jan Child Abduction – Legal Aid Center of Southern Nevada
In early 2016, a woman came to Legal Aid Center of Southern Nevada after the father of her two children, ages 7 and 8, fled the state with the children with no indication of where they went. Legal Aid Center accepted the case. The father had taken the children to Texas. We completed a Complaint for Child Custody and a Motion for the Return of both Children, and our process servers were able to locate the father. We were able to obtain a Court Order requiring both children to be returned to Nevada. Despite many attempts to settle the case, the father falsely stated our client, who suffers from cognitive delays, was a bad mother with substance abuse issues, and the children were being abused by her now husband. The Court held a hearing. During the hearing, we proved, through testimony from the parties and copious evidence, that the father’s claims were untrue. Our client was granted primary physical custody of both children and child support plus arrears. The children and their mother are together and will remain in Nevada.
